FragDB grants you a non-exclusive, non-transferable, worldwide license to use the database solely in accordance with these Terms. For data you have already downloaded, this license is perpetual: it may be revoked only for a violation of these Terms, and revocation does not affect your right to keep and continue using previously downloaded copies in products and analyses you have already built (see § 8.2). The license is personal to you and may not be shared, transferred, or sublicensed.

You may:

• Download and store the database for your own use
• Integrate the database into applications you develop
• Use the data for analysis, research, and business intelligence
• Train machine learning and AI models
• Create derivative works (reports, dashboards, visualizations) for internal use
• Use the data to provide services to your customers (if those services comply with these Terms)

You may not:

• Resell, redistribute, or republish the database or any substantial portion thereof
• Create a competing fragrance data service
• Share your download link or credentials with others
• Remove, alter, or obscure any proprietary notices
• Use the Service for any illegal purpose
• Reverse-engineer or attempt to extract the data structure for competitive purposes
• Reproduce the database for the purpose of redistribution — storing it, backing it up, and loading it into your own systems (databases, backends, analytics pipelines) is expressly permitted under § 2.2
• Use automated tools to re-download or scrape additional copies

FragDB retains all intellectual property rights in the Service itself — the website, its design, and the software that powers it. We do not claim exclusive ownership of the underlying factual information, and we do not pursue licensing claims against customers who transform, reorganize, or build upon data they have purchased. The compiled dataset is the product of our collection and normalization effort; the restrictions that protect it are the contractual ones in Section 2, not a maximalist copyright claim.

The underlying factual information (fragrance names, brands, notes, release dates) is not subject to copyright or database protection under applicable law. What governs your use of the compiled, organized dataset are the contractual restrictions in Section 2 — not a proprietary claim over the information itself.

Brand names and trademarks referenced in the database (Dior, Guerlain, etc.) remain the property of their respective owners. We use these names for descriptive, nominative purposes only.

All payments are in cryptocurrency. By initiating a transaction, you agree to the stated price in USD equivalent at the time of purchase. Prices are subject to change without notice.

All transactions are recorded on a public blockchain. This transaction history is immutable and permanent. By paying, you acknowledge that your transaction details are publicly visible on the blockchain.

All sales are final. Due to the irreversible nature of cryptocurrency transactions and the digital nature of the product, we do not offer refunds or chargebacks. We strongly recommend reviewing our sample data and documentation before purchase.

Annual subscriptions do not automatically renew. You will receive email notifications before your subscription expires. To continue receiving updates, you must manually renew by purchasing a new subscription or upgrading to Lifetime Access.

The product is delivered as downloadable files — it is not a hosted service (SaaS). Once downloaded, the database runs entirely on your side and does not depend on our servers, our APIs, or the continued availability of this website. For subscribers, update deliveries are sent by email with direct download links and continue independently of the availability of the website or of any public repository.

Wherever these Terms or the Service state a period in months or years, a month means 30 consecutive days and a year means 360 consecutive days, counted from the moment your payment is confirmed. An Annual Subscription therefore runs for 360 days from confirmation, and each renewal adds 360 days to the term then running.

THE DATABASE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

FragDB makes no representations or warranties regarding:

• The accuracy, completeness, or timeliness of the data
• The fitness of the database for a particular purpose
• The absence of defects, errors, or omissions
• The security or reliability of the download process
• The synchronisation of snapshot dates across datasets — individual components of a delivery may carry different collection dates

While we strive for accuracy, the database is compiled from multiple sources, some of which are maintained by third parties. We are not responsible for third-party errors or omissions.

We maintain quality control processes, but some data discrepancies may exist. If you discover errors, please report them to [email protected], and we will investigate.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FragDB SHALL NOT BE LIABLE FOR:

• Lost profits or revenue
• Lost or corrupted data
• Business interruption
• Indirect, incidental, special, or consequential damages
• Any damages arising from your use or inability to use the database

This applies even if FragDB has been advised of the possibility of such damages.

FragDB's total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid for the database.

You may cancel your subscription at any time by logging into your account or contacting [email protected].

FragDB may terminate your license immediately if you:

• Violate any material term of these Terms
• Resell or redistribute the database
• Use the Service for illegal purposes
• Violate third-party intellectual property rights through your own conduct

Upon termination:

• Your access to new downloads and updates is revoked immediately
• Active download links expire
• You must not start new uses of the database that these Terms prohibit
• Consistent with § 2.1, previously downloaded copies remain yours: you may keep them and continue using them in products and analyses you had already built

Sections 3 (Intellectual Property), 5 (Warranty Disclaimer), 6 (Limitation of Liability), 7 (Indemnification), and 9-15 survive termination. The perpetual license for previously downloaded data (§ 2.1) and the delivery-continuity commitments (§ 4.5) also survive: what you have already downloaded remains yours regardless of how these Terms end.

You are responsible for:

• Maintaining the confidentiality of your email and download links
• Preventing unauthorized access to your account
• Notifying us immediately of any unauthorized use

You agree not to:

• Share your download links or credentials
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Introduce malware or malicious code
• Use the Service to harass, threaten, or harm others
• Violate any applicable law or regulation

We collect minimal personal data (email address only). For details, see our Privacy Policy.

Your transaction history is recorded on a public blockchain and is permanently visible to the public. We are not responsible for any privacy concerns related to blockchain data.

Except for your email address, any information you provide is non-confidential. We may use feedback, suggestions, or ideas you provide without compensation.

These Terms deliberately do not designate a single national governing law: the Service is borderless and payment is made in cryptocurrency. Disputes are resolved exclusively through the binding arbitration process described in § 13.2. Mandatory consumer-protection rules of your place of residence remain unaffected where they apply by operation of law.

Any dispute arising from these Terms or your use of the Service shall be resolved by binding ad hoc arbitration under the UNCITRAL Arbitration Rules, conducted in English with a single arbitrator; documents-only or remote proceedings are preferred where the rules allow. By using the Service, you waive your right to a jury trial and class action proceedings.

Before initiating arbitration, you agree to attempt to resolve disputes informally by contacting [email protected].

FragDB offers programmatic access to its fragrance database through a metered HTTP API ("API Access"). API Access is a prepaid service: you buy units of access ("units"), and each record the API returns is charged at the unit price of the requested detail level (1 unit for a list record, 2 for a basic record, 4 for a full record). Requests that return no record are not charged. A full-level request for a record that holds nothing beyond its basic level is charged at the basic price; the amount charged is reported with every response. The unit price, detail levels, request limits and the current data release are published on the API page of FragDB and may change for future top-ups; units already purchased keep the price at which they were bought.

Top-ups are made in multiples of USD 50, from USD 100 up to USD 5,000 per invoice, and are credited to your account once the payment is confirmed on the blockchain. API Access carries a minimum spend of USD 100 (40,000 units) per 180 days, counted from your first top-up and restarting whenever a top-up brings a zero balance back above zero. At the end of each 180-day period, any unused part of the minimum spend is deducted from your balance. Units are not refundable (Section 4.3). Buyers of a database file receive a complimentary 500 units valid for 30 days; these units are spent first and expire unused.

Each record you retrieve through the API is licensed to you under Section 2 of these Terms with the following additions:

• Records and images you have retrieved through the API are yours to keep, in the same way as downloaded files (§ 2.1, § 8.2, § 8.3): you may store and cache them without time limit — also after your API account is closed, emptied or terminated — and use them in your own applications, websites, analyses and internal systems, including commercial ones. The restrictions below apply to everything you keep, whether or not your API account still exists.
• You may not resell, sublicense or redistribute the data as an API, a data feed, a database export or any other product whose substantial value is the data itself, and you may not offer a service that lets third parties query our data.
• Image files are served from our content delivery network for use within your application. Hot-linking our images from pages that do not use our data, bulk-mirroring the image store, or serving our images to third parties as a service is not permitted.
• Attribution is not required. You may not state or imply that FragDB endorses your product.

This Section 16.3 survives termination together with the Sections listed in 8.3.

API Access is subject to technical limits published on the API page, currently 300 requests per minute and 10 requests per second per key, 20 requests per second per account, 50,000 charged records per account per calendar day (UTC), up to 5 active keys per account, and 5 index downloads per day. Requests above a limit are rejected without charge. Unusual usage patterns that suggest an attempt to reproduce the whole database at a detail level you have not paid for, to circumvent metering or to share one account between several parties may be throttled. We may raise limits on request.

Records issued through the API keep their identifiers permanently. A record that disappears from its source is kept in the API with its last known content and marked accordingly; it is never deleted or re-used for a different item. Content may be withdrawn only where required by law or by a rights holder, in which case the API returns a specific status for that record. Each data release is versioned; the API reports the current release, and changes to the API contract that would break existing integrations are published as a new version, with the previous version supported for at least 180 days after notice.

API Access is provided on the "as-is" basis of Section 5. Planned maintenance is announced on the API page. Should we suspend API Access for reasons on our side, the minimum-spend clock stops for the duration of the outage.

Use of the API in breach of Sections 2, 16.3 or 16.4 entitles FragDB to suspend or close your API account; the remaining balance is forfeited, in addition to the remedies in Section 8.

API Access is not available through anonymising networks. Where FragDB restricts access to its website from a country, API Access may nevertheless be available from that country; to check availability from your country, write to [email protected].

API keys identify your account and are shown once at creation. You are responsible for every request made with your keys, including requests made after a key is leaked, until you revoke it in your dashboard. Keys may not be embedded in client-side code distributed to end users.
