By accessing and using FragDB (the "Service"), downloading the database (the "Product"), or completing a payment transaction, you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service or purchase the Product.
2. LICENSE GRANT & RESTRICTIONS
2.1 Limited License
FragDB grants you a non-exclusive, non-transferable, revocable, worldwide license to use the database solely in accordance with these Terms. This license is personal to you and may not be shared, transferred, or sublicensed.
2.2 Permitted Uses
You may:
- Download and store the database for your own use
- Integrate the database into applications you develop
- Use the data for analysis, research, and business intelligence
- Train machine learning and AI models
- Create derivative works (reports, dashboards, visualizations) for internal use
- Use the data to provide services to your customers (if those services comply with these Terms)
2.3 Prohibited Uses
You may not:

- Use automated tools to re-download or scrape additional copies
3. INTELLECTUAL PROPERTY RIGHTS

FragDB retains all intellectual property rights in the Service, including the database compilation, website design, and software. The arrangement and selection of the data is protected by copyright and database laws.
3.2 Factual Information
The underlying factual information (fragrance names, brands, notes, release dates) is not subject to copyright or database protection under applicable law. However, the compiled, organized, and structured presentation of this information is proprietary and protected.
3.3 Third-Party Content
Brand names and trademarks referenced in the database (Dior, Guerlain, etc.) remain the property of their respective owners. We use these names for descriptive, nominative purposes only.
4. PAYMENT & BILLING
4.1 Payment Terms
All payments are in cryptocurrency. By initiating a transaction, you agree to the stated price in USD equivalent at the time of purchase. Prices are subject to change without notice.
4.2 Blockchain Transactions
All transactions are recorded on a public blockchain. This transaction history is immutable and permanent. By paying, you acknowledge that your transaction details are publicly visible on the blockchain.
4.3 No Refunds
All sales are final. Due to the irreversible nature of cryptocurrency transactions and the digital nature of the product, we do not offer refunds or chargebacks. We strongly recommend reviewing our sample data and documentation before purchase.
4.4 Subscription Renewal
Annual subscriptions do not automatically renew. You will receive email notifications before your subscription expires. To continue receiving updates, you must manually renew by purchasing a new subscription or upgrading to Lifetime Access.
5. LIMITED WARRANTY & DISCLAIMER
5.1 "As-Is" Basis
THE DATABASE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
5.2 No Warranties
FragDB makes no representations or warranties regarding:
- The accuracy, completeness, or timeliness of the data
- The fitness of the database for a particular purpose
- The absence of defects, errors, or omissions
- The security or reliability of the download process
5.3 No Liability for Third-Party Content
While we strive for accuracy, the database is compiled from multiple sources, some of which are maintained by third parties. We are not responsible for third-party errors or omissions.
5.4 Data Quality

6. LIMITATION OF LIABILITY
6.1 No Consequential Damages

This applies even if FragDB has been advised of the possibility of such damages.

FragDB's total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid for the database.
7. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless FragDB from any claims, damages, losses, or expenses (including attorneys' fees) arising from:
- Your use of the database
- Your violation of these Terms
- Your infringement of third-party rights using the database
- Any claims that your use of the data violates applicable law
8. TERMINATION
8.1 Termination by You
You may cancel your subscription at any time by logging into your account or contacting [email not configured].
8.2 Termination by FragDB
FragDB may terminate your license immediately if you:
- Violate any material term of these Terms
- Resell or redistribute the database
- Use the Service for illegal purposes
- Violate third-party intellectual property rights
Upon termination:
- Your access is revoked immediately
- Download links expire
- You must cease using the database for any new purposes
- You may retain previously downloaded copies for archival purposes only
8.3 Survival
Sections 3 (Intellectual Property), 5 (Warranty Disclaimer), 6 (Limitation of Liability), 7 (Indemnification), and 9-15 survive termination.
9. USER CONDUCT & SECURITY
9.1 Account Security
You are responsible for:
- Maintaining the confidentiality of your email and download links
- Preventing unauthorized access to your account
- Notifying us immediately of any unauthorized use
9.2 Prohibited Conduct
You agree not to:
- Share your download links or credentials
- Attempt to gain unauthorized access to the Service
- Interfere with or disrupt the Service
- Introduce malware or malicious code
- Use the Service to harass, threaten, or harm others

11. MODIFICATIONS TO SERVICE
FragDB reserves the right to:
- Modify, update, or discontinue the Service at any time
- Change pricing, features, or terms of service
- Remove or modify database content
Changes will be announced via email to active subscribers. Continued use constitutes acceptance of modified terms.
12. THIRD-PARTY SERVICES
The Service may integrate with or link to third-party services (payment processors, hosting providers, etc.). We are not responsible for third-party conduct, privacy practices, or service availability. Use of third-party services is at your own risk.
